Brian Webster has represented my niece and I in a brain injury case since 1993, this case was extremely difficult, and very complex. This case was finally resolved this last spring, with the ruling in our favor. On September 29, 1996 our 31-year-old son was hit head on by a driver who had fallen asleep at the wheel and crossed the centerline on the highway. As he lay in a coma in the ICU of Vancouver General, we were told that he had suffered a serious brain injury and may not make it. He had also suffered other extensive injuries throughout his body.

Brian Webster was recommended to us by a councilor at Vancouver General. Immediately upon meeting Brian Webster we all felt that he was the right person to represent our son. He was very patient while we described our son's accident and the injuries he had received and with the many questions we all had about the future. Brian started the ball rolling immediately and assigned us a caseworker who was a former employee of G.F. Strong. Everyone, including ICBC, treated our son like gold and we believe this had a lot to do with the respect everyone had for Brian.

I was involved in a very serious pedestrian accident in 1990, which left me with a brain injury. Brian Webster was referred to my family to assist us with the legal proceedings that arose from this accident. It turns out that Brian did more than just help us with the legal process. He made sure that I received the best care and therapy possible.

Brian first started working for me through my family, as I was in no condition to know what I needed. He spent a great deal of time and care making arrangements for us. Brian was faced with a great deal of obstacles in my case due to the precedence that it set. On September 13, 1996 my son Aaron age 19, was a seat belted back seat passenger involved in a single vehicle accident. There were no drugs or alcohol involved in this accident. My son received a star burst fracture of the C7 vertebrae. This caused him to become an incomplete quadriplegic. There are no words to describe the grief and shock our family felt. During the initial stages of my son's treatment I was quickly learning the complications and future care needs associated with an injury of this magnitude. At this time I was being asked to sign insurance forms and speak with adjusters from I.C.B.C., I was hearing terms such as part 7. I decided at this point to retain a personal liability lawyer to help me ensure that my son would receive the best care and rehabilitation possible, and that his future care needs would be addressed. As well as his long term permanent disabilities.

At this time I obtained the names of six law firms and lawyers. I interviewed them all. I then narrowed it down to three and had them meet my son. At this time we felt most comfortable with Brian Webster.

Some of the things that my son & I took into consideration were:
1. Experience in the area of spinal cord and traumatic brain injury.

Dear Brian,

This letter is to thank you for a job well done. You skillfully and successfully carried us through the legal process with ICBC. You could do this because of your legal skill and experience but more importantly because of your patience and ability to handle my brain injured daughter, Sarah. As you know we had consumed two lawyers before you and the case was a bit of a mess when you agreed to take over. I sometimes wonder if you regretted your decision.

Because of Sarah's lack of insight, ideas have to be carefully presented to her and reinforced. She can't perceive herself to be outside of things or feel backed into a corner. This is to mention only a few of her deficits. You were able to conduct a legal case and handle her with kid gloves even outside the court room while the trial was in process. You navigated our way to a successful settlement. Thank you. Sarah is immersed in helping animals through the Wildlife Society and working towards a course in becoming a veterinary technologist. I'm not sure she will achieve her goal but she is taking very positive steps towards it.

These years since the accident have been difficult for our family. I nursed my father through cancer the last year of his life, my younger daughter was diagnosed with Crohn's, recently spent 2 months in hospital returning home with a illeostomy, I returned full time to teaching and left my husband.

I am trying to help Sarah as much as I can but I don't want to be pulled down again and she seems to do better when she learns through life experience or from anyone other that her mother. Knowing that she will never want for money makes things so much easier. I am still looking for an opportunity to persuade her to accept the help of a counselor, she could benefit in so many ways. She is currently realizing she needs a tutor for her high school updating courses. The story goes on. I know you still have occasional contact with Sarah, not always positive, but thanks for your patience. Also Dee, you are included in this. you are a very important part of the team.

Since I initially wrote this I have returned to you for help and advice. Although the case is technically over, Dee spent quite a while talking to me on the phone and, Brian, you phoned me twice to make sure you returned my phone call and patiently answered my questions and explained legal matters for me. You also invited me to call whenever I need further help.

As a parent of a survivor of a Traumatic Brain Injury I cannot stress how important it is for the survivor and family to have the right legal representation. My journey of life took a permanent sharp bend on June 30, 1992. My husband, Arthur, as a pedestrian, was struck by a half-ton truck in Surrey, B.C. He was taken by ambulance to the Royal Columbian Hospital emergency ward with multiple skull fractures. He was put on a ventilator, stabilized, and sent to ICU. I was notified via telephone as our home is here in Austin, Manitoba. Art had been out in B.C. with his semi tractor and trailer for work. Six members of his family and myself caught the first available plane out, 6 a.m. July 1, 1992.

Following a very long trip and expensive taxi ride we found Art in ICU. He was in a comatose state, with a very swollen head and many tubes. One look at him removed all hope that he was not seriously injured. We were shown x-rays and results of cat scans. Due to the impact Art had sustained severe brain injuries, some areas of injury much larger than others but damage throughout his entire brain.

We stayed many hours a day at his bedside whenever we were allowed into the ICU. On July 6, 1992 Art's sister, Kathy, and I were looking for information on the brain. We are both nurses but if one is not working in a neurological area you soon forget. The ICU did not have any books for us to learn from and suggested we call the BC Brain Injury Assoc. which we did that day. At that point in time we did not get the requested material but received some very valuable information which would be of benefit for Art's future. The client co-ordinator, Janice Kell, asked, Have you got a lawyer? We were quite taken aback. A lawyer-well no! In the state of mind we were all in no one had thought of a lawyer or that we might even need one. We were given three names of lawyers and the first one we made arrangements to meet with was Brian Webster. We were impressed from our first conversation with Brian as he suggested he would come over to us in New Westminster from his office in Richmond as we had no vehicle to go to see him. He was very professional but at the same time we never felt he talked down to us. Over the weeks and months that we worked with Brian we realized he knew a great deal about brain injuries and the devastation that not only the survivor but the whole family has to learn to deal with. He encouraged me to learn as much as possible about brain injury and its effects on the survivor. At first I just wanted to take Art home but I slowly came to realize he would need many things such as a great deal of rehabilitation. Brian encouraged me to go to Winnipeg and look into the program there and then to do the same with the G.F. Strong Centre in Vancouver so I would feel informed when making that very important decision for Arthur. The committeeship that I had to apply for Arthur was a very difficult thing to do for [and] in so doing I had to admit to myself that Art was so seriously injured that he could not make decisions for himself. Brian thoroughly explained the process to me and supported me through this very emotional time. When preparing for trial I felt that Brian was very well prepared. For example he hired an expert to lay out the cost of future care for Art. Things like this I would never ever have thought of - I was still unrealistically thinking of taking my husband home, looking after him and everything would be fine!

I knew from the beginning that Brian was there to ultimately see that his client Arthur was taken care of in the best possible way. But I also soon realized he was there for myself and the family too as Brian knows that brain injury not only affects the survivor but every member of his/her family as well.

I have been able to phone Brian any time of day. If he is not available he always phones me back. It is nearly seven years since Art was hurt and though I don't have to call Brian as often any more, when I do need help or information he is still always there for Arthur, myself and the family --- he really does care!

Three years ago, my daughter, Michelle (age 19) was walking on the side of the highway and was struck by a drunk driver and left to die! Fortunately, her walking companion was able to quickly flag down a passing car. Due to the quick response of the ambulance, local emergency ward, air evacuation team, Vancouver General's emergency ward and neuro-surgical doctors, her life was saved.

Michelle was in a coma for 2 months and when she came out of it, was left with many problems: complete right side paralysis, blind spots in her vision and no long or short term memory to name a few. After three years, Michelle is still working to put her life back together.

If you are reading this you may be going through something similar, maybe less, maybe more and you will need a lawyer. If you are like me, the last thing you want to do is pick a lawyer. You need to do this anyway. Not only because you will be dealing with the police and ICBC who have their own lawyers with years of experience, but also to get the best help available from the doctors, hospitals and rehabilitation community, which at the beginning is the most important.

We are really glad that we called Brian Webster when our son was involved in an accident a few years ago.

Things didn't look very good and a lot of lawyers would probably have told us that they couldn't help us, but Brian thought it was worth taking to examination for discovery. Now maybe tomorrow or another day this may happen again as we are driving down the road in the daytime. Codey will be amazed at something he has just rediscovered, or it may be seeing the moon again in the daylight for the first time in his memory. Sharing it with us again,with no recall of ever having shared the same before. But instead of feeling absolutely heart broken that he does not remember this simple fact, we try and share in his joy of the moment of discovery.

This reference letter was received by a client who had a fall from his roof and made a claim for payment pursuant to his own insurance policy.  The claim was denied for multiple reasons, but ultimately we were able to obtain payment of the policy limits.
