Brian Websiter, Q.C. "Our firm is survivor-focused: our objectives are to ensure that every opportunity for survivor rehabilitation is realized to the fullest, and to recover maximum damages for any remaining disability."

Brian Webster, Q.C.

Introduction

The law offices of Webster & Associates provide effective, caring legal representation for survivors of traumatic brain injury (TBI) caused by negligence. Many of our cases are related to motor vehicle crashes, but also include injury sustained from falls, sports, medical malpractice, or class action suits for those injured by the fault of others. Located within ten minutes of Vancouver International Airport, Webster & Associates has contacts around the world. We can assist those who have been injured in British Columbia or those who have suffered serious injury elsewhere in the world, but reside in British Columbia.

Our primary aims are twofold. One, to ensure that each survivor's treatment allows for maximum rehabilitation so that he or she may recover to the fullest extent possible. Two, Webster and Associates obtains maximum financial recovery.

We are sensitive to the needs of the survivor's family, recognizing the extraordinary pressures and considerable changes which traumatic brain injuries bring to bear. We work closely with survivor families to assure that family members are able to cope with these changes, and provide assistance in securing counselors, finding support groups, and in engaging the services of other professionals whose care may help ease the strain of establishing a new lifestyle.

Working with a group of carefully chosen experts and specialists, we complete a thorough evaluation to clearly identify the long-term effects of the survivor's TBI, and focus our resources on effective legal representation to achieve maximum damages for survivor disabilities. Working with experienced investigators, engineers and others, we put together forceful cases to establish liability.

Because of the many variables that affect how brain injuries manifest in each individual, every injury is unique and complex. To best serve the interests of the TBI survivor, your litigator must have an intimate knowledge of law and a working understanding of neurology, neuroanatomy, neuroimaging, neuropsychology, neuropsychiatry, rehabilitation medicine and related disciplines.

The principal in our firm, R. Brian Webster, has practiced law for nearly 30 years, and continues to devote considerable time and effort to further expanding his legal and medical knowledge. He is a voracious reader, with a considerable library, who maintains close working relationships with medical and health care professionals.

Mr. Webster regularly participates in both law and brain injury conferences and workshops in British Columbia and the United States, and is in constant discussion with colleagues on issues related to TBI. He is an energetic advocate for TBI survivors who actively participates in both the B.C. Brain Injury Association and the B.C. Coalition of People with Disabilities.

About Our Representation

"Our considerations are survivor recovery and rehabilitation, and maximum damage awards."

We coordinate our services with those provided by medical, treatment and other professionals to ensure that every client reaches the full potential of his or her recovery.

Care for the survivor and family

Because brain injury inextricably involves both family and survivor, we extend the scope of our practice to encompass both. We place special emphasis on communicating with our clients, as well as with the survivor's treatment support network, to ensure that our clients have a clear understanding of the injury, its long range implications, and the remedies that are available. We prepare the legal groundwork to assure that the survivor and his or her family are prepared for the changes that lay ahead, drawing on a range of services to forecast future needs. Using legal channels, we then go on to secure the resources that will be required to meet those needs.

Personal Representation

The principal of Webster and Associates, Mr. Brian Webster, personally represents each client. His efforts are supported by skilled associates who provide day-to-day case management as Mr. Webster works with clients, medical and treatment personnel; prepares for trial; and appears in court.

A skilled litigator with much experience in the field of personal injury and TBI, Mr. Webster has handled cases for clients from every corner of British Columbia, as well as Alberta, Yukon Territory, the United States, China and Great Britain.

We have built a firm that is known for its dedication to survivor advocacy, thorough preparation and tough litigation.

Help in gathering and interpreting information

To prepare our clients, we gather information about the survivor's medical condition and prognosis. We liase with the care manager and members of the treatment support network to ensure that our client is provided with all of the pertinent facts. We review the material with our client to ensure that he or she clearly understands the information presented, carefully review the options available and help to weigh the ramifications of various decisions. We walk our clients through the decision process, so that in the end he or she may feel comfortable and secure, knowing that their decisions are based on complete information and are carefully reasoned.

Help to avoid unnecessary problems

Survivor recovery may take many months, and the road to rehabilitation even longer. We understand the agony and frustrations that the survivor and family endure, and work diligently to help you avoid as many problems as you can, and to help find appropriate solutions for those that do arise.

Help in dealing with finances

TBI survivors and their families are often faced with staggering financial burdens, resulting from medical costs, occupational and economic loss, and the cost of life-long survivor care. We provide counsel and legal assistance to anticipate costs and help arrange to deal with them. We also focus on ensuring that needed support for survivor deficits is met.

Full support of qualified specialists

We have developed a solid network of skilled advisors who contribute valuable expertise. These include neurological medical professionals who provide comprehensive examination, evaluation, diagnosis, treatment, rehabilitation, and expert testimony. We also work with qualified life care planners and financial experts who evaluate and project expenses and develop financial management plans so that necessary mechanisms, such as trust funds, can be set up to provide optimum financial protection and security for each survivor.

Empathetic, clear-minded counsel

The time required to bring a TBI case to trial, and the enormity of the process, can take a toll on both survivor and family. We provide our clients with needed emotional support as we work through the litigation process with them. At the same time we are careful to maintain an objective distance so that we may always offer the clear-minded counsel our clients need to make the careful choices and sound decisions required to achieve the best results possible to recover the most money possible.
